Founded in New York City in 1986 by vocalist Jimmy Williams, Maximum Penalty emerged during the golden era of New York hardcore and established themselves as one of the scene's most distinctive bands. While their early material was rooted in fast hardcore punk, the band gradually developed a more melodic and emotionally expressive sound. Rather than relying exclusively on aggression, Maximum Penalty incorporated melody, memorable songwriting and soulful clean vocals into their hardcore foundation. The result is a sound that stands apart from the more conventional NYHC template while retaining the energy and attitude of the scene.

The band's first major creative period produced an impressive catalog, including Demo 89, the East Side Story EP, Independent and Super Life, alongside appearances on influential compilations. Despite its significance, Independent remained unavailable on vinyl for 30 years.
